Age Discrimination

In October 2006 the long-awaited Age Discrimination Regulations come into force. Many of you will be aware of these Regulations but who will be affected; what will be the implications for your business and what can you do now to prepare?

Who will be affected?

The Regulations will impose new obligations on all employers as well as on recruitment agencies and consultancies, educational institutes, Trade Unions and professional associations and trustees and managers of occupational pension schemes. The protection of the legislation will extend to all ‘workers’ including all employees, the self employed, contract workers, office holders and members of Trade Unions and the like. Anyone applying for work and those undertaking or applying for employment related vocational training will also be protected.

Implications for your business?

You should ensure that you comply with the Regulations at every stage of the employment cycle. Job advertisements should no longer contain 'ageist' words such as 'youthful', 'mature', 'dynamic'. Specific requirements as to post-qualification experience should also be avoided. All employees should have access to appropriate training and the opportunity for career progression. Each employee must be offered the opportunity to continue working after the 'default' retirement age of 65.

How can you prepare?

  • Review and evaluate the age profile of your workforce
  • Review and update all relevant documentation
  • Raise awareness and train your staff (an employer is potentially liable for the discriminatory acts of an employee)

Finally

Although the Regulations will have far-reaching implications for your business it is not all bad news. The Regulations will give rise to a larger pool of potential employees and enable you to retain valuable skills and experience and increase profitability as a consequence.
